Against the decisions of the Federal Office applicant for asylum may bring legal actions before the German administrative court. The applicant is informed about possible legal remedies and time limits in the instructions on legal remedies attached to the decision on asylum.
If, during the claim’s court proceedings, the court confirms the conditions to grant protection, the court repeals the notice or the relevant parts of the notice of the Federal Office for Migration and Refugees and remands the case to the Federal Office for a positive decision, i.e. to grant protection.
If the court rejects the claim and confirms the refusal of all types of protection status, for the affected person the obligation to exit Germany remains.
If the applicant does not fulfil the obligation to exit Germany, he/she will be deported to his/her home country. Responsible for conducting the deportation is the particular Aliens Department.
If a deportation is not possible, the Aliens Department can grant a short-term permit or also a residence permit.
