Decision-making competence of the Federal Office

On basis of the Asylum Procedure Law (AsylVfG) each application for asylum includes an application for the following:

- international protection (§ 1 I No 2 AsylVfG)

- refugee protection (§ 3 I AsylVfG)

- subsidiary protection (§ 4 I AsylVfG)

AND

- entitlement to asylum (Section 16a I GG)

If international protection cannot be granted and the recognition of the entitlement to asylum does not apply, the Federal Office also decides, whether prohibitions to deport according to § 60 V or VII AufenthG (Aufenthaltsgesetz, German Residence Law) apply.
