If protection seekers enter by air, a special procedure applies in the case of an application for asylum, the so-called "airport procedure".
The asylum procedure is conducted in the transit area of the airport before the German Federal Police decides on entry. Though, it is conducted only, if
- the person has no false identity papers on him/her or
- comes from a safe home country.
If the request for asylum is rejected as “manifestly unfounded”, entry is denied. The applicant stays in the transit area of the airport.
The applicant may appeal to the administrative courts against this rejection of the application for asylum to reach emergency legal protection. If the court rules in favour of the applicant, he/she is permitted to enter Germany; if the court ruling is negative, he/she is deported.
